Does America Need More Lawyers Right Now?

The other day, I met with an acquaintance who had considered going back and getting his masters at USC in California, but noted his tuition costs would be $25,000 per year. If he totally went for it, and didn't have a job, he could potentially finish from his current level of schooling to complete his masters in 2-years, but said that 3 or even 4 would be more like it considering he'd need to also work to pay for it. Should he borrow the money and go for it?

Four years would be $100,000 and that's just not doable, plus he already has student loans he's paying on and they are at 5.5% well prior to the current rates, or legislated low rate guarantee levels. Now then, there was an interesting piece in the Wall Street Journal on August 8, 2013 titled; "Legal Education on Trial: Is the Third Term Necessary?" by Jennifer Smith.

The article was written due to a comment President Obama made - that a law degree ought to be possible in two years not three, as that would provide greater opportunity for those who couldn't afford it and for those who'd have to pay off those student loans after they graduated and presumably passed the bar.

In the article, Law Professor Michael A Olivas stated; "If we are not producing good results in three years - and many critics say we are not - how are we going to do it in two years?"

Okay, but I ask the following questions rhetorically:

1. Do we currently have a shortage of lawyers in this great nation?
2. Why are the laws in our country so complicated that it takes so long to learn how it all works?

To the first question, let me answer a resounding; NO. We have too many lawyers in the market now, law firms are laying off, and we don't need more by lowering the bar (pun intended).

Next, in response to question number two; the reason our laws currently on the books are so complicated is because we've created too much case law due to too many lawyers and because we have too many lawyers as lawmakers making too many laws as it is, thus, we don't need any more lawyers.

Lastly, let me remind everyone that President Obama did his full stint in law school, but had his law license taken away, you can fact check that. May I ask why his opinion in this matter is even credible? I believe it isn't. I don't claim to know what the number of class hours we should require for law degrees, only that we've become a nation "for the lawyers and by the lawyers" and it is time we changed all that. Please consider all this and think on it.
